Terms of Service

1. Agreement

By accessing or using Zaar ("Service"), operated by TogoFlow ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Zaar provides tools to generate, edit, and manage social media–oriented content using artificial intelligence and related features, principally for advertising and marketing use cases as described in Section 3. Features, availability, and pricing may change over time. We may suspend or discontinue parts of the Service with reasonable notice where practicable.

3. Intended use (advertising and marketing)

Zaar is offered for the creation of advertising and marketing creative assets, including images, layouts, and related materials intended for paid or organic social campaigns, digital advertising, email and landing-page visuals where used in promotional context, and comparable brand marketing communications. This intended purpose applies regardless of whether a particular asset is ultimately published.

You agree to use the Service only for bona fide advertising and marketing activities that comply with these Terms, our acceptable use requirements, and applicable law. You must not use the Service to generate content at scale or on a sustained basis for purposes that are not genuinely related to advertising or marketing (for example, personal non-commercial projects unrelated to brand promotion, or bulk generation unrelated to campaigns) without our prior written consent. We may suspend or terminate access if we reasonably believe use falls outside this intended scope or harms the Service or other users.

Disclaimer for non-advertising use and unused outputs. We do not control how you deploy assets after export. To the fullest extent permitted by law, TogoFlow is not responsible for any generated images, videos, text, or other outputs that are used or intended to be used outside advertising or marketing contexts, or that are never used in ads or marketing campaigns. You assume all risk and liability for selection, clearance, publication, and performance of creative assets, including where an output is not placed in an advertisement. Nothing in this Section limits your obligations under Section 6 (Disclaimers) or Section 7 (Limitation of liability).

4. Accounts and organizations

You are responsible for safeguarding your credentials and for activity under your account and any organization you administer. You must provide accurate information and keep it up to date. You may not share accounts in a way that circumvents access controls or billing.

5. Fees, billing, and auto-renewal

Paid plans, credits, and add-ons are described at checkout and in-product. All prices are in US Dollars (USD) unless stated otherwise. Taxes may apply depending on your location and are your responsibility.

Recurring subscriptions. Monthly and annual Zaar Pro subscriptions are automatically renewed at the end of each billing period (monthly or annually, as selected) at the then-current price, unless you cancel before the renewal date. By subscribing you authorise us and our payment processors to charge your payment method on a recurring basis until you cancel.

Cancellation. You may cancel your subscription at any time from your billing settings page. Cancellation stops future automatic charges; your access continues until the end of the period you have already paid for, after which it lapses. No partial-period refunds are issued.

Refunds. All fees are non-refundable except as required by applicable law or as we expressly agree in writing. Prepaid credits expire as stated in the product and are non-refundable.

Payment processing. Payments are processed by Stripe, Inc. and Flutterwave Inc. Card data is handled by those processors in accordance with their terms and privacy policies; we do not store full card numbers on our servers.

6. Intellectual property

We retain all rights in the Service, branding, and underlying technology. Subject to these terms and your plan, you receive a limited license to use outputs as permitted in these Terms and product documentation. We do not claim ownership of your original prompts or pre-existing materials you supply.

7. Disclaimers

The Service and AI-generated outputs are provided "as is" and "as available." We do not warrant uninterrupted or error-free operation, or that outputs will meet any particular legal, regulatory, or commercial standard. You are responsible for how you use outputs, including compliance with advertising rules, platform policies, and intellectual property laws. The disclaimers in Section 3 apply in addition to this Section.

8. Limitation of liability

To the maximum extent permitted by law, neither TogoFlow nor its suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability arising out of these terms or the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100), except where liability cannot be limited by law.

9. Changes

We may modify these terms by posting an updated version and updating the "Last updated" date. Material changes may be communicated in-product or by email where appropriate. Continued use after changes become effective constitutes acceptance unless applicable law requires a different process.
